Fall Retreat 2026 — Participation Agreement, Waiver & Release
Golden Hill Retreat Center · Coldspring, Texas · October 19–22, 2026
This Participation Agreement, Waiver and Release of Liability (the “Agreement”) is entered into between Future Focus Female LLC, a Texas limited liability company, together with its founder Kimberly Curtis and its officers, members, employees, contractors, agents, volunteers, and guest presenters (collectively, “FFF” or the “Released Parties”), and the individual participant identified and signing electronically at the end of this Agreement (the “Participant,” “I,” or “me”). By initialing the acknowledgments in the accompanying intake form and by signing this Agreement electronically, I agree to all of the terms and conditions set forth below.
1. Educational Nature — Not Medical Care
Kimberly Curtis is a Certified Ayurvedic Life Coach, iPEC Energy Leadership Coach, Certified Yoga Instructor, Culinary Chef, Integrative Wellness Educator, and Perimenopause Protocol Designer. She is not a licensed medical professional and does not provide medical services of any kind. All content presented at this retreat — including all perimenopause, menopause, Ayurvedic, nutritional, and movement material — is for educational and informational purposes only and does not constitute medical advice, diagnosis, or treatment. Nothing offered at this retreat is a substitute for care from a qualified, licensed healthcare provider. I will not disregard, or delay in seeking, professional medical advice because of anything I learn or receive at this retreat. I am responsible for my own health decisions, and I have been advised to consult my own physician before participating, before beginning any new movement practice, and before making any change to my nutrition, supplements, or lifestyle based on retreat content. FFF makes no promise, warranty, or guarantee of any particular health, wellness, symptom, weight, or other outcome, and I understand that individual results vary.
2. Voluntary Participation & Personal Responsibility
My participation in the Future Focus Female Fall Retreat 2026 (the “Retreat”) is entirely voluntary. The Retreat may include Hatha yoga and movement, meditation, breathwork and yoga nidra, use of a heated swim spa and hot tubs, infrared sauna, cold plunge, healing-lounge treatments, biomat and massage chair, outdoor time on rural forest property, meals prepared on-site, and travel to and from the venue. I am responsible for knowing my own body, my own ability, my own medical restrictions, and when and how to modify, and this responsibility applies to every activity I take part in. Modifications are offered for every practice, and it is my responsibility — not the instructor’s — to choose the variation appropriate to me on any given day. I may stop, rest, modify, or opt out of any activity at any time, without needing permission or explanation, and I will not push past my own limits. I may decline any activity, including heat, cold, water, bodywork, or movement, at any time.
3. Personal Medications & Health Communication
I am solely responsible for any medications I bring to the Retreat, including keeping them safely secured and out of the reach of others, and I do not need anyone’s permission to bring what I need for my own health. FFF and Golden Hill Retreat Center do not store, administer, monitor, or take responsibility for any participant’s medications. It is my responsibility — not FFF’s — to communicate my own health information, conditions, and needs to my family, friends, or emergency contact, and to ensure they know where I am, what I am doing, and what to do in the event of an emergency. FFF is not responsible for knowing, tracking, or relaying my health information, and does not serve as my medical decision-maker or medical power of attorney.
4. Food, Allergens & Dietary Matters
Meals are prepared by the Golden Hill Retreat Center kitchen in a shared commercial kitchen and follow a keto-Ayurvedic framework with dosha-specific seasoning adjustments. Because meals are prepared in a shared kitchen, neither FFF nor Golden Hill Retreat Center can guarantee that any dish is free from cross-contact with allergens. If I have a severe or life-threatening food allergy, I am responsible for disclosing it, for evaluating whether the Retreat environment is appropriate for me, and for carrying my own emergency medication. I accept full responsibility for my own dietary choices during the Retreat.
5. Assumption of Risk
I understand that participation in the Retreat involves inherent and other risks of physical injury, illness, emotional distress, property loss, permanent disability, and death. These risks include, but are not limited to, those arising from yoga and movement practice; breathwork; heat and cold exposure; water immersion; bodywork and healing-lounge modalities; food preparation and consumption; slips, trips, and falls; uneven and rural terrain; wildlife and insects; weather; travel to and from the venue; the acts or omissions of other participants; and the limited availability of emergency medical services at a rural location. I knowingly and voluntarily assume all such risks, both known and unknown, whether arising from the negligence of the Released Parties or otherwise, and I accept full responsibility for my participation.
6. Communicable Illness — Assumption of Risk
I understand that any gathering of people carries an inherent risk of exposure to and transmission of communicable illnesses, including but not limited to colds, influenza, norovirus, COVID-19, and other contagious viral, bacterial, or infectious conditions, and that participants may be traveling from other regions or countries. I acknowledge that FFF does not screen, test, verify, or monitor the immunization status, vaccination records, or health records of any participant, staff member, provider, or third party, and is under no obligation to do so. I voluntarily assume all risk of exposure to and illness from communicable disease arising before, during, or after the Retreat, and I release FFF and the Venue Parties from any and all claims relating to such exposure or illness. I agree that it is my own responsibility to make informed decisions about my participation in light of these risks.
7. Release & Waiver of Liability
In consideration of being permitted to participate, I, for myself and for my heirs, spouse, executors, administrators, personal representatives, insurers, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Future Focus Female LLC, Kimberly Curtis, and their officers, members, employees, contractors, agents, volunteers, and guest presenters (the “Released Parties”), and separately Golden Hill Retreat Center and its owners, employees, contractors, and agents (the “Venue Parties”), from any and all claims, demands, actions, causes of action, damages, costs, and expenses of any kind, including attorneys’ fees, arising out of or related in any way to my participation in the Retreat, my presence on the Retreat premises, or my travel to or from the Retreat. I further waive the right of any of my insurers to bring any such claim by way of subrogation or otherwise.
8. Express Assumption of Negligence Risk
I SPECIFICALLY AND EXPRESSLY UNDERSTAND AND AGREE THAT THIS RELEASE AND COVENANT NOT TO SUE APPLIES TO CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES AND THE VENUE PARTIES, INCLUDING NEGLIGENT INSTRUCTION, NEGLIGENT SUPERVISION, NEGLIGENT SELECTION OF ACTIVITIES OR PROVIDERS, AND NEGLIGENT MAINTENANCE OF THE PREMISES. This release does not extend to gross negligence, willful or intentional misconduct, or any liability that may not be released as a matter of Texas law.
9. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties and the Venue Parties from and against any loss, liability, damage, penalty, or cost, including reasonable attorneys’ fees, that they may incur arising out of or relating to my participation in the Retreat, including any claim brought by a third party as a result of my acts or omissions, and including any claim arising from my failure to disclose a medical condition, allergy, or restriction relevant to my safe participation. This obligation survives the conclusion of the Retreat and the termination of this Agreement.
10. Medical Authorization
If I am injured or become ill and am unable to consent, I authorize FFF and Golden Hill Retreat Center to summon emergency medical care on my behalf. I understand that neither is obligated to provide, arrange, or pay for medical care, and I accept full financial responsibility for any medical treatment I receive.
11. Third-Party Providers & Rural Setting
Lodging, meals, healing-lounge modalities, bodywork, and the physical premises are provided by Golden Hill Retreat Center and its own independent providers. FFF does not employ, supervise, train, or control those providers, does not verify their licensure, and is not responsible for the services they render or for the condition of the premises. I further understand that Golden Hill Retreat Center is a rural property located in a national forest area, that emergency medical services may take significantly longer to arrive than in an urban setting, and that cellular service may be limited.
12. Media Release
Photography and video may be captured during the Retreat for FFF’s marketing and educational use. My media consent is recorded separately in the intake form and is optional; my choice there does not affect my participation. Where I have consented, I grant FFF and Kimberly Curtis the irrevocable, perpetual, worldwide, royalty-free right to photograph, film, record, and use my name, likeness, image, voice, testimonial, and statements in any medium now known or later developed for FFF’s marketing, promotional, and educational purposes, without compensation, and I waive any right to inspect or approve the finished materials. This Retreat is a confidential space; I agree not to photograph, record, or publish any other participant without her express permission, and not to share what another participant discloses during the Retreat.
13. Retreat Policies
Payment & Cancellation
My registration was paid in full at booking and is non-refundable. If I am unable to attend, FFF is under no obligation to refund, credit, or transfer my registration, though it may do so at its sole discretion.
Conduct & Right to Remove
I will treat other participants, Kimberly, and Golden Hill Retreat Center staff with respect. FFF reserves the right to refuse or terminate the participation of any person whose conduct is unsafe, disruptive, or harmful to others, or who FFF reasonably believes may cause harm to the Retreat, its participants, or FFF, without refund and at that person’s own expense for departure.
Alcohol & Substances
I will not use alcohol or non-prescribed substances during Retreat programming or before any physical practice, heat, cold, or water activity.
Personal Property
I am responsible for my own belongings. Neither FFF nor Golden Hill Retreat Center is liable for lost, stolen, or damaged property.
Schedule Changes
The schedule, menu, activities, and providers are subject to change. Weather, venue conditions, or circumstances beyond FFF’s control may require substitution or cancellation of any element without refund.
Travel & Insurance
I am responsible for my own transportation to and from the venue and for my own travel and health insurance. I have been advised to consider trip insurance.
14. Governing Law & Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions. I irrevocably agree that the exclusive venue for any dispute, suit, action, or proceeding arising out of or relating to this Agreement or the Retreat shall lie in the state courts located in Nueces County, Texas, and I submit to the personal jurisdiction of those courts.
15. Severability & Entire Agreement
This Agreement, together with the accompanying intake form and its initialed acknowledgments, constitutes the entire agreement between me and FFF concerning its subject matter and supersedes all prior discussions, understandings, and representations. If any portion of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect, and the invalid portion shall be construed as narrowly as necessary to make it enforceable. This Agreement shall be construed as broadly as permitted by Texas law in favor of the Released Parties and the Venue Parties.
16. Acknowledgment & Electronic Signature
I HAVE READ THIS ENTIRE AGREEMENT. I understand that it is a legally binding contract that includes a waiver and release of liability, a covenant not to sue, an assumption of risk (including the risk of ordinary negligence and of communicable illness), and an indemnification obligation. I understand that Kimberly Curtis is not a licensed medical professional and that all Retreat content is educational only. I understand that I am responsible for knowing my own body, my own ability, and my own medical restrictions, and when and how to modify in every activity. I am signing this Agreement freely and voluntarily, of my own choice and without inducement, and I intend my typed or drawn electronic signature and my typed initials on the accompanying form to constitute my legal signature under Texas law and to be a complete and unconditional release to the fullest extent permitted by law.
